LEGAL ASPECTS

  • This clinical psychiatric nursing therapy practice is governed by the following Acts and Regulations:
  • Nursing Act, Act no. 33 of 2005 and Regulations
  • Mental Health Care Act, Act no. 17 of 2002
  • Medical Schemes Act, Act no. 131 of 1998
  • Prevention of and Treatment for Substance Abuse act, Act no. 70 of 2008 and regulations
  • Medicines and Related Substances Act, Act no. 101 of 1965
  • Children’s Act, Act no. 38 of 2005 as amended
  • Protection of Personal Information Act, Act no. 4 of 2013
  • Criminal Procedure Act, Act no. 51 of 1977
  • Older persons Act, Act no. 13 of 2006
  • National Health Act, Act no 61 of 2003 and regulations
  • This practice is POPIA Act 4 compliant.

PRIVACY

  • Protection of Personal Information Act, Act no 4 of 2013.
  • Due to the confidential nature of the service rendered, the therapist/counsellor is under no obligation to respond to any WhatsApp or SMS messages.
  • The need to relay any important, new information, new developments or any other information will be done via email and/or in person.
  • No information regarding diagnosis, therapeutic intervention, progress / outcomes can be made available to a third party without consent of the patient/guardian.
  • No written report will be provided pertaining to diagnoses, therapeutic intervention, treatment progress and outcome unless requested in writing due to statutory or legal proceedings. In such cases a report must be requested in writing via the legal representative/authority and fees will apply. No recommendation outside of the original mandate of involvement, in this case therapeutic intervention, can be made.
  • Normal patient-therapist confidentiality will apply. However, it is important to note that the therapist /counsellor is under both ethical and legal obligation to report any information related to child neglect, child abuse, frail/elderly neglect and/or abuse, neglect and abuse of any disabled person and or sexual abuse to relevant legal authorities, SAPS and local welfare organizations.
